May 8, 2020 7:11 PM 3rd Circuit Court: government's regulation of ore processing plant during wartime does not make it liable under the CERCLA On Monday, the 3rd Circuit Court of Appeals held that the Government's involvement at a chromite ore processing plant during World War I and World War II does not make it an "operator" under § 107(a)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). May 8, 2020 7:07 PM Department of Education announces final rule regarding Title IX regulations On May 6, the Department of Education announced a final rule amending the regulations implementing Title IX of the Education Amendments of 1972. The rule addresses how education institutions must respond to allegations of sexual harassment consistent with Title IX’s prohibition against sex discrimination. “The final regulations obligate recipients to respond promptly and supportively to persons alleged to be victimized by sexual harassment, resolve allegations of sexual harassment promptly and accurately under a predictable, fair grievance process that provides due process protections to alleged victims and alleged perpetrators of sexual harassment, and effectively implement remedies for victims.” See Final Rule . May 8, 2020 7:00 PM Federal Court issued an injunction preventing the enforcement of Kentucky’s travel ban On May 4, a U.S. District Court issued a preliminary injunction declaring Kentucky’s travel ban order invalid and prohibiting its enforcement. The travel ban prohibited Kentucky residents from “travelling out of state, except when required for employment; to obtain groceries, medicine, or other necessary supplies; to seek or obtain care by a licensed healthcare provider; to provide care for dependents, the elderly, or other vulnerable person; or when required by court order.” The Court reasoned that the ban was not narrowly tailored to achieve the government’s purpose. May 8, 2020 6:59 PM U.S. Supreme Court overturns convictions in ‘Bridgegate’ case On May 7, the U.S. Supreme Court issued their opinion regarding the “Bridgegate” incident, where two port authority officials reduced George Washington bridge from three lanes to one as retribution for a mayor refusing to back the governor’s campaign. The Court overturned the convictions under the federal-program fraud or wire fraud laws, reasoning that the scheme here did not aim to obtain money or property, and as such, the defendants could not have violated the federal-program fraud or wire fraud laws. May 8, 2020 6:57 PM Federal Court rejects claims alleging that Nevada’s all-mail election plan is unconstitutional On April 30, a federal court rejected plaintiff’s claims that Nevada’s all-mail election “strips voter-fraud-prevention safeguards and unconstitutionally violates plaintiffs' right to vote due to purported vote dilution.” The Court reasoned that the state’s “interests in protecting the health and safety of Nevada's voters and to safeguard the voting franchise in light of the COVID-19 pandemic far outweigh any burden on Plaintiffs' right to vote, particularly when that burden is premised on a speculative claim of voter fraud resulting in dilution of votes.” See Decision . According to GAO, in April 2019, it identified 17 priority recommendations for EPA.
